Recently, a U.S. District Court ordered the U.S. Department of Homeland Security (DHS) to accept first-time requests for Deferred Action for Childhood Arrivals (DACA), a program by the Obama Administration to extend employment benefits to aliens who entered the United States as children through no fault of their own. As a result, starting December 7, 2020, the United States Citizenship and Immigration Services (USCIS) has resumed accepting first-time DACA requests from those who meet the following requirements:
You may request DACA if you:
- you were under 31 years old on June 15, 2012;
- you came to the United States before your 16th birthday;
- you have continuously resided in the United States since June 15, 2007;
- you were physically present in the United States on June 15, 2012;
- you did not have legal status on June 15, 2012;
- you’re currently in school; OR
- you have obtained a GED certificate; OR
- you have been honorably discharged from the Coast Guard or Armed Forces of the United States; and
- you have not been convicted of a Felony; OR
- you have not been convicted of any significant misdemeanor; OR
- you have not been convicted of three or more misdemeanors.
If you answer YES to all of the questions above, then you’re eligible to apply for DACA for the first time.
